Terms of Service

Welcome to CreatorHub. These Terms of Service ("Terms") govern your access to and use of the CreatorHub mobile application ("App") operated by CreatorHub ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. Description of Service

CreatorHub is a marketplace platform that connects creative professionals ("Creators") with individuals and businesses seeking creative services ("Clients"). The App facilitates:

CreatorHub acts as a platform facilitator. We are not a party to the agreements between Creators and Clients, nor are we an employer of any Creator.

3. User Accounts

3.1 Registration

To use the App, you must create an account using either email/password or Apple Sign In. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You may delete your account at any time through the App. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are reported for abusive behavior.

6. Bookings and Payments

6.1 Booking Process

Clients may request bookings with Creators through the App. Bookings are subject to Creator availability and approval. A booking is confirmed once the Creator accepts and payment is processed.

6.2 Payment Processing

All payments are processed securely through Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service. CreatorHub does not store your full payment card details.

6.3 Platform Fees

CreatorHub charges a service fee on bookings. The fee structure is disclosed to both Clients and Creators before a booking is confirmed. Fees are non-negotiable and subject to change with notice.

6.4 Creator Payouts

Creators receive payouts through Stripe Connect. Payout timing and methods are subject to Stripe's policies and the Creator's Stripe Connect account configuration.

6.5 Taxes

Creators are solely responsible for determining and paying any applicable taxes on their earnings. CreatorHub does not withhold taxes on behalf of Creators. Clients are responsible for any applicable sales tax on their purchases.

7. Cancellations and Refunds

7.1 Client Cancellations

Creators who cancel confirmed bookings may face account penalties including reduced visibility in search results. Repeated cancellations may result in account suspension.

7.3 No-Shows

If a Creator fails to show up for a confirmed booking, the Client may request a full refund through the App. If a Client fails to show up, the Creator retains the full booking payment.

7.4 Disputes

If a dispute arises between a Client and Creator, both parties should first attempt to resolve it through the App's messaging feature. If a resolution cannot be reached, either party may contact CreatorHub support for mediation.

8. Content and Intellectual Property

8.1 User Content

You retain ownership of content you upload to the App (portfolio images, videos, messages, reviews). By uploading content, you grant CreatorHub a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce that content as necessary to operate the App.

The intellectual property rights in work produced by Creators for Clients are governed by the agreement between the Creator and Client. CreatorHub makes no claim to ownership of deliverables.

Clients may leave reviews and ratings for Creators after a completed booking. Reviews must be honest, relevant, and based on actual experience. CreatorHub reserves the right to remove reviews that violate these Terms or our content guidelines. Creators may not offer incentives in exchange for positive reviews.

11. Blocking and Reporting

Users may block or report other users for violations of these Terms. CreatorHub will review reports and take appropriate action, which may include warnings, content removal, or account suspension. Abuse of the reporting system may result in action against the reporting user's account.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

14. Limitation of Liability

To the maximum extent permitted by law, CreatorHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App, including but not limited to:

Our total liability for any claim arising out of these Terms shall not exceed the amount of fees you paid to CreatorHub in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless CreatorHub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email at least 30 days before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CreatorHub regarding your use of the App.
