Terms of Service

1.Acceptance of Terms

By downloading, accessing, or using the CreatorHubb mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. CreatorHubb reserves the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2.Description of Service

CreatorHubb is a marketplace platform that connects creative service providers ("Creators") with individuals seeking creative services ("Seekers"). The App facilitates discovery, booking, communication, payment processing, and delivery of creative services. CreatorHubb acts solely as an intermediary platform and is not a party to any agreement between Creators and Seekers.

3.Eligibility and Account Registration

You must be at least 18 years old to use the App. By creating an account, you represent that:

• All information you provide is accurate, complete, and current
• You will maintain the accuracy of your account information
• You are responsible for all activity under your account
• You will not create multiple accounts or share your credentials

You may register using email/password or Sign in with Apple. CreatorHubb may suspend or terminate accounts that violate these Terms without prior notice.

4.User Roles

Seekers may browse Creator profiles, request bookings, communicate with Creators, make payments, and leave reviews.

Creators may set up professional profiles, manage availability and pricing, accept or decline bookings, deliver completed work, and receive payouts.

Users may switch between roles. Each role is subject to its own obligations under these Terms.

5.Bookings and Transactions

All bookings made through the App constitute agreements between Creators and Seekers. CreatorHubb does not guarantee the quality, timeliness, or completion of any services. Creators are independent contractors and not employees, agents, or representatives of CreatorHubb.

Once a booking is confirmed and paid, both parties are expected to fulfill their obligations. Failure to do so may result in penalties, account restrictions, or removal from the platform.

6.Payments, Fees, and Payouts

All payments are processed securely through Stripe, a PCI-compliant third-party payment processor. CreatorHubb does not store or have access to your full payment card details.

Fee Structure:

• Seekers pay a 10% service fee on each booking
• Creators pay a 7% platform fee deducted from their earnings

Creator Payouts: Creators in countries supported by Stripe Connect (including the United States, United Kingdom, European Economic Area, Canada, and Switzerland) receive payouts through Stripe Connect and must complete Stripe's onboarding and identity verification. Payout timing is determined by Stripe's processing schedule.

Creators in other countries receive payouts by bank transfer executed through Wise (or a comparable transfer service). Earnings from a booking become available for payout only after the booking is completed (delivery confirmed by the Seeker or auto-confirmed). Available earnings can be withdrawn in the App, subject to a minimum withdrawal amount of $10.00 USD; transfers are sent in the Creator's local currency and typically arrive within 1–2 business days. CreatorHubb may also send accumulated earnings on a periodic schedule. Earnings held for payout do not accrue interest.

All amounts are in US Dollars (USD). Fees are non-refundable except as described in Section 7.

7.Cancellations and Refunds

Either the Seeker or the Creator may cancel a booking or request a refund through the App at any time before the Creator has delivered the completed work. The following cancellation and refund policy applies to all bookings unless otherwise specified:

• Creator cancels: Seeker receives a 100% refund
• Seeker cancels 24+ hours before the booking: 100% refund
• Seeker cancels 12–24 hours before the booking: 50% refund
• Seeker cancels less than 12 hours before the booking: No refund

After Delivery: Once the Creator has uploaded a delivery for a booking, in-app self-service refunds are no longer available. If you believe a refund is warranted after delivery, contact CreatorHubb support through the App and our team will review your request.

No-Show Claims: If a Creator fails to appear for a confirmed booking, the Seeker may submit a no-show claim through the App. Approved no-show claims result in a full refund to the Seeker.

Refunds are returned to your original payment method and typically take 5–10 business days to appear on your statement. Platform service fees may not be refundable depending on the circumstances.

CreatorHubb reserves the right to issue refunds at its sole discretion in cases of fraud, service non-delivery, or disputes that cannot be resolved between the parties.

8.Content and Intellectual Property

Users retain ownership of content they upload to the App, including portfolio items, profile information, photos, videos, and reviews. CreatorHubb does not claim ownership of your content.

License to CreatorHubb: By uploading content, you grant CreatorHubb a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, use, reproduce, display, distribute, and adapt your content (for example, by cropping, resizing, or reformatting it) to operate the platform and to promote CreatorHubb and the Creators on it. We may sublicense these rights only to service providers and platforms that help us do this, such as hosting, social media, and advertising services.

Featuring Your Work: CreatorHubb may feature your content, together with your name, profile photo, and a link to your profile, in the App, on our website, on social media, in advertising, in email, and in app store listings. You will not receive a fee, royalty, or other payment for this. The exposure it gives you and your work is the benefit. We aim to credit you whenever we feature your work, but a missing or incorrect credit is not a breach of these Terms. CreatorHubb decides what to feature, is not required to feature anyone's content, and may stop featuring any content at any time.

What We Will Not Do: We do not sell your content. We do not license your content to others for their own use, we do not put it on products or merchandise for sale, and we do not use it to train artificial intelligence models or provide it to others for that purpose.

Opting Out and Ending the License: You can ask us to stop featuring your work in new promotions at any time through Contact Support in the App's Help Center or by email at admin@creatorhubb.com. Promotions already published may remain. When you delete content or your account, this license ends for that content, except for promotions already published, copies we must keep by law, and copies in routine backups until they are overwritten. We are not responsible for copies of published promotions that others make or share, such as screenshots or reposts.

Your Responsibilities: You represent that you own or have the necessary rights to all content you upload, including permission from every person who appears in it to be shown in the App and in promotions as described above, and that your content does not infringe the intellectual property, privacy, or publicity rights of any third party.

Removal of Content: CreatorHubb may remove or restrict any content, or suspend or close any account, that violates these Terms or that we reasonably believe infringes the rights of others, with or without notice.

Copyright Complaints: If you believe content in the App infringes your copyright, send a notice to our copyright agent at admin@creatorhubb.com that includes: (1) your name and contact information; (2) a description of the copyrighted work; (3) where the content appears in the App, such as the Creator's profile and the specific item; (4) a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature. We will remove or disable access to the content and notify the user who uploaded it. A user who believes content was removed by mistake may send a counter notice to the same address. We close the accounts of repeat infringers.

CreatorHubb may display sample, educational, inspirational, or location-based content that includes or references third-party materials from sources such as Pexels, Unsplash, Wikipedia, and Wikimedia. Pexels imagery is used under the Pexels License, and Unsplash imagery is used under the Unsplash License. Wikipedia and Wikimedia content, when used, is attributed and handled under its applicable Creative Commons or other source-specific license. Third-party content remains owned by its respective rights holders.

CreatorHubb is not affiliated with, sponsored by, or endorsed by Pexels, Unsplash, Wikipedia, Wikimedia, or their contributors. Users may not remove attribution, copyright notices, source links, or license notices shown with third-party content.

Portfolio videos are hosted and streamed through Mux, a third-party video infrastructure provider. By uploading videos, you acknowledge that your video content will be stored on and delivered through Mux's servers.

The CreatorHubb name, logo, and App design are the property of CreatorHubb and may not be used without written permission.

9.Prohibited Conduct

You agree not to:

• Provide false or misleading information
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Post illegal, harmful, or offensive content
• Attempt to circumvent platform fees by transacting outside the App
• Use the App for any unlawful purpose
• Interfere with or disrupt the App's functionality
• Scrape, crawl, or collect data from the App without permission
• Create fake reviews or manipulate ratings

Violations may result in immediate account suspension or permanent removal from the platform.

10.Reviews and Ratings

Users may leave reviews and ratings after completed bookings. Reviews must be honest, relevant, and based on genuine experiences. CreatorHubb reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms. Creators may respond to reviews publicly.

11.Communication and Content Moderation

The App provides in-app messaging for communication between Seekers and Creators. All communications should remain on-platform for your protection.

Content Moderation: To protect users and prevent off-platform transactions, the App automatically scans messages, bios, and project descriptions for contact information such as phone numbers, email addresses, social media handles, and payment platform references. Detected contact information is automatically redacted or removed. This scanning is performed on-device and no redacted content is transmitted to external services.

Chat Attachments: Users may send images, videos, and documents through in-app messaging. Images are stored in Firebase Cloud Storage, and videos are processed and stored through Mux. All attachments are subject to CreatorHubb's content guidelines and may be removed if they violate these Terms. Messages and attachments are not end-to-end encrypted.

Automated Support: When you contact CreatorHubb support through the App, you may initially interact with an automated support system that provides answers to common questions. If the automated system cannot resolve your inquiry, your conversation will be escalated to a human support representative.

Push Notifications: CreatorHubb may send you push notifications regarding bookings, messages, payments, and platform updates. You can manage notification preferences in the App settings or through your device settings.

12.Account Deletion

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Some data may be retained as required by law or for legitimate business purposes (e.g., completed transaction records, fraud prevention). Outstanding payments or obligations must be settled before account deletion.

13.Content Delivery

Creators deliver completed work to Seekers through the App's delivery system. Deliveries may include links to external file-hosting services such as Dropbox, Google Drive, iCloud, WeTransfer, or other platforms.

CreatorHubb is not responsible for the availability, security, or content of external delivery links. Creators are responsible for ensuring delivery links remain accessible for a reasonable period. Seekers should download delivered content promptly, as external links may expire.

Delivery Confirmation: After a Creator uploads a delivery, the Seeker may confirm or dispute it through the App. If the Seeker does not confirm or dispute a delivery within 3 days of upload, the delivery is automatically confirmed and the booking is marked complete. Reminders are sent approximately 1 day and 2 days after upload, and the final reminder states when automatic confirmation will occur. Once a booking is complete, the Creator's earnings become eligible for payout.

CreatorHubb does not review, verify, or guarantee the quality or completeness of delivered content. Disputes regarding deliveries should be reported through the App.

14.Disputes Between Users

CreatorHubb provides a dispute resolution process for issues between Seekers and Creators. Either party may file a dispute through the App.

Dispute Process:

• Disputes are reviewed by CreatorHubb's moderation team
• Both parties may be asked to provide evidence or context
• CreatorHubb will investigate and reach a resolution

Possible Outcomes:

• Dismissal if the dispute lacks merit
• Mediation between the parties
• Warning issued to the offending party
• Temporary suspension of the offending account
• Permanent ban from the platform
• Refund issued to the affected party

CreatorHubb's decision on disputes is final. Repeated violations or serious offenses may result in immediate account termination without warning.

15.Platform Monitoring and Safety

To maintain a safe and fair marketplace, CreatorHubb employs automated systems to monitor platform activity. This includes:

• Detection of unusual account creation patterns
• Monitoring of cancellation and refund rates
• Identification of potentially fraudulent behavior

Accounts flagged by these systems may be reviewed by our team. CreatorHubb reserves the right to suspend or terminate accounts engaged in fraudulent or abusive behavior.

CreatorHubb administrators may access user data, booking records, messages, and account information as necessary to operate the platform, resolve disputes, enforce these Terms, and comply with legal obligations.

16.Blocking and Reporting

Users may block or report other users through the App. Blocking a user prevents them from contacting you or viewing your profile. Reports are reviewed by CreatorHubb's moderation team and may result in warnings, suspension, or removal of the reported account.

Abuse of the blocking or reporting features (e.g., filing false reports) may result in action against the reporting user's account.

17.Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. CreatorHubb does not warrant that the App will be uninterrupted, error-free, or secure. CreatorHubb does not endorse, guarantee, or assume responsibility for any services provided by Creators.

18.Limitation of Liability

To the maximum extent permitted by law, CreatorHubb and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App
• Any transaction or relationship between Seekers and Creators
• Unauthorized access to your data
• Any third-party content or conduct on the App
• Content delivered through external links or third-party services

CreatorHubb's total liability shall not exceed the amount of fees you have paid to CreatorHubb in the 12 months preceding the claim.

19.Indemnification

You agree to indemnify and hold harmless CreatorHubb and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App; your content, including any claim that your content, or our use of it as permitted by these Terms, infringes or violates the rights of any third party, including people who appear in it; your violation of these Terms; or your violation of any third-party rights.

20.Legal Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with applicable rules, rather than in court. You agree to waive any right to participate in class action lawsuits against CreatorHubb.

21.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

22.Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

23.Changes to Terms

CreatorHubb reserves the right to modify these Terms at any time. Material changes will be communicated through the App or via email at least 30 days before taking effect. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
